Terms and Conditions for eazy.photo

These terms and conditions apply to the use of eazy.photo, including creating an account, purchasing event packages, creating events, uploading photos and videos, and using event galleries, QR codes, links, and associated features.
By using eazy.photo, you accept these terms.
The terms apply to event hosts, guests, and other users who access or upload content to eazy.photo.

3. The Service
eazy.photo is a digital platform for events.
The platform enables an event host to create an event gallery and invite guests to upload photos and videos from the event.
Access to an event can take place via, among other things, an event link, QR code, token, or other access mechanism.
The host can administer the event and the uploaded content. Depending on the host's settings, photos and videos can be displayed in a private gallery, shared gallery, live wall, photo kiosk, or similar event features.
Event features are not separate purchases. They can be toggled on and off by the host, to the extent they are available for the relevant event package or account.
eazy.photo does not deliver a physical product.
4. Who the Terms Apply To
These terms apply to:

If you use eazy.photo on behalf of a company, association, organisation, or other legal entity, you warrant that you have the right to accept the terms on behalf of that entity.
5. Age Requirements
You must be at least 18 years old to create a host account, purchase event packages, or create events on eazy.photo.
If you are under 18 years old, you may only use eazy.photo with consent from a parent or guardian.
By using eazy.photo, you confirm that you are either 18 years old or have the necessary consent.
6. Formation of Agreement
When you purchase an event package or other paid access to eazy.photo, you enter into an agreement with eazy.photo.
The agreement is formed when the purchase is completed and the event package, event, or access to eazy.photo is made available to you.
You will normally receive a confirmation or receipt at the email address you have provided.
You are responsible for ensuring that the email address and information you provide upon purchase or account creation are correct.
7. Payment
Payment for event packages is made as a one-time amount, unless otherwise clearly stated at the time of purchase.
All prices are shown in Danish kroner, DKK, and inclusive of VAT, unless expressly stated otherwise.
The payment methods that can be used are shown in the payment flow on eazy.photo.
The amount is charged when the purchase is completed.
If a payment cannot be processed, eazy.photo may reject or restrict access to the purchased event package or account.
8. Delivery
eazy.photo delivers digital content and digital services.
Delivery takes place digitally and immediately when the purchase is completed and the event package, event, or access to eazy.photo is made available.
Delivery may take place, among other things, when:

No physical product is delivered.
9. Limited Right of Withdrawal
eazy.photo delivers digital event packages and digital services that are not delivered on a physical medium.
Delivery takes place immediately after purchase, when the event package, event, or access to eazy.photo is made available.
Upon purchase, you expressly consent to delivery commencing immediately, and you simultaneously acknowledge that the ordinary statutory 14-day right of withdrawal does not apply upon immediate delivery.
For purchases from eazy.photo, there is therefore no ordinary 14-day right of withdrawal after delivery.
However, eazy.photo offers a limited right of withdrawal as a voluntary service.
The limited right of withdrawal means that you can withdraw your purchase until the day before the event start date.
From the event start date onwards, the purchase can no longer be withdrawn.
Withdrawal can only take place by direct contact via email to hey@eazy.photo.
Your email about withdrawal must be received by eazy.photo no later than the day before the event start date.
You must clearly state that you wish to withdraw the purchase and provide us with the information necessary to find the purchase, for example email address, event name, or order number.
If you validly exercise the limited right of withdrawal, we will refund the amount paid.
Refund will as a rule be made to the same payment method used for the purchase, unless otherwise agreed.

The limited right of withdrawal is a voluntary service from eazy.photo and does not limit your mandatory rights under applicable law.
10. The Host's Responsibility
As a host, you are responsible for the way you create and use your event.
This includes, among other things:

| Moderation | You should delete content that should not be in the event. |
| Children and vulnerable persons | You should be particularly attentive at events with children, young people, or vulnerable persons. |
| External use | If you download, share, or publish material outside of eazy.photo, you are responsible for this use. |
As a host, you have access to moderation tools and can at any time delete photos and videos from your event galleries.
You can delete content for any reason.
11. Guests' Responsibility
As a guest, you are responsible for the content you upload to an event.
You may only upload photos and videos that you have the right to share.
You must not upload content that:

You should take particular care if photos or videos show children, vulnerable persons, private situations, or persons who do not wish to be shared.
12. Rights to Uploaded Photos and Videos
You retain as a rule all rights to photos and videos you upload yourself, if you otherwise hold the rights to the material.
When you upload photos or videos to an event on eazy.photo, you grant the event host a global, non-exclusive, royalty-free, and irrevocable right of use to use the material in connection with the event.
This right of use includes, among other things, the right to:

Upon upload, you also grant eazy.photo the right to technically process, store, display, convert, copy, and make the material available to the extent necessary to deliver the service, ensure operations, provide support, prevent abuse, enforce terms, and fulfil legal obligations.
eazy.photo does not use uploaded photos or videos for marketing, advertising, cases, social media, product promotion, or AI training without separate, voluntary, and explicit consent.
13. Prohibited, Illegal, and Inappropriate Content
It is strictly prohibited to upload illegal or inappropriate content to eazy.photo.
Illegal content is content that under applicable law is illegal to record, store, upload, share, or publish.
Inappropriate content is content that eazy.photo does not permit on the platform, even if the content is not necessarily illegal in all contexts.
eazy.photo may remove or restrict access to both illegal and inappropriate content without notice.
13.1 Overview of Illegal Content
Illegal content includes, among other things:

| Incitement to violence or crime | Content that incites violence, assault, vandalism, stalking, hacking, fraud, or other crime. |
| Illegal weapons use or weapons trade | Content that shows, promotes, or facilitates illegal possession, sale, manufacture, or use of weapons. |
| Illegal substances | Content that shows, promotes, or facilitates the purchase, sale, manufacture, distribution, or use of illegal substances. |
| Illegal hate speech | Content directed at persons or groups on the basis of e.g. race, skin colour, nationality, ethnicity, beliefs, disability, gender, sexuality, or similar, when the content is illegal under applicable law. |
| Privacy violations | Secret recordings, surveillance, doxxing, sharing of private information, or photos from private situations without a lawful basis. |
| Copyright infringement | Photos, videos, music, graphics, or other material that the user does not have the right to upload or share. |
| Fraud and identity misuse | Fake documents, phishing, misuse of others' identity, or content used for fraud. |

CSAM and sexual material involving minors are strictly prohibited and will be reported to relevant authorities.
eazy.photo reserves the right to report other illegal content to relevant authorities and to retain necessary documentation if it is necessary to handle the case, protect persons, enforce terms, or fulfil legal obligations.
13.2 Overview of Inappropriate Content
Inappropriate content includes, among other things:

| Violence | Photos or videos showing violence, assault, fighting, abuse, torture, or serious physical injury. |
| Blood and graphic content | Photos or videos with large amounts of blood, open wounds, serious injuries, mutilation, or other graphic content. |
| Excrement | Photos or videos of faeces, urine, vomit, or other bodily waste in an offensive, humiliating, or improper context. |
| Terror and extremism | Content that shows, glorifies, supports, promotes, or imitates terror, terrorist organisations, extremist violence, or terror-like acts. |

13.3 Pornographic and Sexual Content
You must not upload pornographic or sexual content.
This includes, among other things:

| Sexual material involving minors | Any form of sexual or sexualised material involving persons under 18 years of age is strictly prohibited and will be reported to the authorities. |
Ordinary private event photos where, for example, swimwear, breastfeeding, or non-sexual nudity occurs in a natural and non-exposing context are assessed on a case-by-case basis.
eazy.photo may remove content if we assess that it has a sexual, pornographic, offensive, or improper nature.
13.4 Photos and Videos of Substances
You must not upload photos or videos of substances.
This includes, among other things:

Content involving legal medication, medical equipment, or similar may be permitted if it appears in a lawful, non-promotional, and ordinary context.
eazy.photo may remove content if we assess that it shows or promotes illegal substances or substance abuse.
13.5 Photos and Videos of Weapons
You must not upload photos or videos of weapons in a non-sporting or non-artistic context.
This includes, among other things:

| Weapons as props without clear context | Content where weapons are shown without a clear legitimate context, and where the presentation may appear threatening, violent, or unsettling. |
Photos or videos of weapons may under certain circumstances be permitted if they appear in a clear and legitimate context.
This may for example be:

Even in these situations, eazy.photo may remove content if it is assessed to be threatening, violent, glorifying, illegal, unsettling, or otherwise in violation of the terms.
13.6 Violence, Blood, and Graphic Content
You must not upload violent, bloody, or graphic content.
This includes, among other things:

| Glorification of violence | Content that presents violence as desirable, impressive, or entertaining in a harmful way. |
Content from ordinary events where minor accidents, sports injuries, or similar are shown in a non-graphic and non-glorifying context is assessed on a case-by-case basis.
eazy.photo may remove content if it is assessed to be violent, graphic, shocking, offensive, or unsuitable for the platform.
13.7 Excrement and Bodily Waste
You must not upload content involving excrement or bodily waste in an offensive, humiliating, or improper context.
This includes, among other things:

Ordinary situations involving small children, care, illness, or similar may be assessed on a case-by-case basis if the content is not exposing, offensive, or improper.
13.8 Terror and Extremist Content
You must not upload terror-related or extremist content.
This includes, among other things:

| Symbols and tributes | Content that pays tribute to terrorist acts, terrorists, or extremist violence. |
| Violent extremism | Content that incites, legitimises, or glorifies violent extremism. |
Historical, journalistic, documentary, educational, or artistic content may be assessed on a case-by-case basis if the context is clear and the content does not promote, glorify, or incite terror, extremism, or violence.
14. Moderation and Deletion of Content
The host can at any time delete content from their event gallery.
eazy.photo may also remove or restrict access to content if we assess that the content:

eazy.photo is not obligated to actively review all content that is uploaded.
If we become aware of content that may be illegal, inappropriate, or in violation of the terms, we may assess the content and take appropriate action.
This may include, among other things, deletion, restriction of access, closure of event, suspension of account, or reporting to relevant authorities.
15. Abuse and Exclusion
You must not misuse eazy.photo.
Abuse includes, among other things:

| Circumvention | Attempts to circumvent payment, access control, storage limitations, or security features. |
If we establish abuse, we may with immediate effect:

16. Operational Stability and Availability
We work to deliver a stable, secure, and usable service.
However, interruptions, errors, maintenance, capacity issues, or circumstances beyond our control may occur.
eazy.photo does not guarantee that the service will always be available without errors or interruptions.
We may make changes, carry out maintenance, or impose temporary limitations if necessary for operations, security, error correction, capacity, or further development of the service.
17. Data Security and Data Loss
We work continuously to protect photos, videos, and other data in eazy.photo.
We monitor the system for errors and attempt to respond and resolve issues as quickly as possible.
However, security can never be fully guaranteed.
eazy.photo cannot be held liable for data loss caused by:

| Expiry of retention period | Automatic deletion after the relevant retention period. |
Our total liability cannot exceed the amount the user has paid for the relevant event, unless mandatory legislation provides otherwise.
18. Storage
Storage is calculated according to the decimal system.

If an event reaches its storage limit, upload or certain features may be restricted until space is freed up or additional capacity is purchased, if this is offered.
19. Intellectual Property Rights to eazy.photo
All rights to the eazy.photo platform belong to eazy.photo or our rights holders.
This includes, among other things:

You must not copy, modify, resell, rent, distribute, decompile, reverse engineer, or otherwise exploit the eazy.photo platform without written permission.
20. Privacy and Personal Data
When you use eazy.photo, we process personal data.
This may include, among other things, account information, event information, guest names, photos, videos, technical information, payment information, and support information.

If there is any inconsistency between these terms and the privacy policy regarding the processing of personal data, the privacy policy applies to the specific processing of personal data.
21. Complaints and Errors
If you experience errors with eazy.photo or believe there is a defect in the digital service, you must contact us at hey@eazy.photo within a reasonable time after you have discovered the error.

22. Complaint Options
If you wish to complain about a purchase or service from eazy.photo, you should in the first instance contact us at hey@eazy.photo.
If we are unable to find a solution, you can submit a complaint to the Mediation Team for Consumer Complaints (Mæglingsteamet for Forbrugerklager).
If a solution is still not found, the case may be brought before the Consumer Complaints Board (Forbrugerklagenævnet).

23. Changes to the Terms
We may update these terms if we change the service, prices, features, legal basis, processes, or other matters that affect the use of eazy.photo.
Material changes will be communicated to active hosts via email or in the application.
The current version will at all times be available at eazy.photo.
Continued use of eazy.photo after the changes have taken effect is considered acceptance of the updated terms.
24. Choice of Law and Jurisdiction
These terms are subject to Danish law.
Any dispute that may arise in connection with the use of eazy.photo shall be settled by the Danish courts, unless mandatory consumer protection legislation provides otherwise.
The Court of Aalborg (Retten i Aalborg) is agreed as the court of first instance, to the extent this can validly be agreed under applicable law.
